Disick could face child custody battle with Kardashian

Virginia residents may have heard that long-time couple and reality TV stars Kourtney Kardashian and Scott Disick have announced their split. The two have three young children together.

The breakup, which was confirmed on July 6, was reportedly spurred by Disick’s past alcohol and drug abuse. While it is not yet known if he will seek custody of the couple’s three young children, some legal observers said his substance abuse problems won’t necessarily disqualify him from obtaining some parental rights.

Courts highly value the parent-child relationship and will often do all it can to strengthen that bond. To that end, substance abuse issues, joblessness, mental health problems and spousal abuse are not automatically viewed as nonstarters in child custody negotiations. However, Disick could still face an uphill battle if he seeks custody of his kids, particularly if Kardashian chooses to fight him. He may have to agree to conditions such as mandatory drug testing and supervised visitation in order to spend time with his children. Overall, family law courts attempt to do what is in the best interests of the children. If Disick and Kardashian are both deemed fit, the court will likely do all it can to allow both of them access to their children.

Child custody disputes can be difficult for both parents, and unfortunately the contentiousness can affect their children as well. A parent who is going through one may want to seek the assistance of a family law attorney in helping to negotiate an agreement that is in the child’s best interests and that can obtain the approval of the court having jurisdiction over the matter.
