When divorce is better for the children

Virginia parents who are concerned about how separation will affect their children might wonder if they should postpone a divorce. In some cases, it might be better for the children if the parents stay together. In other cases, however, divorce is still the best choice.

Parents may decide to postpone the divorce if they feel that they need to spend more time in counseling trying to repair the relationship. They might also look at the divorce drawbacks and decide that they are greater than the advantages. According to some studies, divorce can increase the likelihood that a child will later get a divorce as well. It can also lead to emotional problems for children and reduce the likelihood that the child will attend college. These may all be reasons for the parents to stay together.

However, staying together may involve sacrifices parents are unwilling to make. For example, it could mean not having a fulfilling marriage. Children may be aware of their parents’ unhappiness, and this can create stress for them. The parents might realize they simply cannot get along and that they will be happier if they are not together. Some marriages can be abusive, which should never be tolerated.

A couple that is getting a divorce will have to divide property and work out a plan for child custody. One spouse may be required to pay spousal support to the other if there is a significant disparity in income. The couple might prefer to negotiate child custody and property division instead of going to court. This allows them to stay more in control of the outcome. However, if the marriage is ending because of abuse or other serious issues, the couple could turn to litigation. A judge will decide what kind of custody arrangement is in the best interests of the child.
