How parents can resolve custody issues

In many cases, Virginia parents are granted joint legal child custody after a divorce. It is not uncommon for them to disagree from time to time as to how their children should be raised. If a disagreement does arise, it is important to understand the options available to remedy those disputes. For instance, it may be possible to seek a resolution in court through litigation.

However, this may simply be a waste of money for parents who are squabbling over minor issues. This is because judges aren't in the business of micromanaging or ruling on day-to-day decisions a parent makes for a child. Therefore, it may be better to pursue alternative options such as mediation.

Another alternative is a collaborative divorce, which allows both parties to hire an attorney while agreeing that neither side will pursue litigation. If either party does pursue litigation, that person has to find a new attorney. In some cases, input may be sought from the child if necessary. If an agreement is reached in either scenario, it will become binding on all parties, and changes can only be made if both parties agree to them in the future.

After a divorce, parents may still have disputes with each other over child custody or other matters. Therefore, it may be beneficial to seek the counsel of an attorney. An attorney may be able to help a parent come to an agreement with a child's other parent either in court or through other means. Coming to a final resolution may allow a parent to establish a better relationship with a child, which may be in his or her best interest.
